Acceptance of Terms

By accessing or using the Pepesto application, you agree to adhere to and be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the application.

Registration

To use our application, you may need to register and provide certain information. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Use of the Service

You agree to use the service for its intended purpose and not to misuse it in any manner. Pepesto reserves the right to terminate or suspend your account without prior notice if you violate any of the Terms.

Data & Privacy

Your use of the application is also governed by our Privacy Policy and Consent Agreement, which outlines our data practices.

Use of the API

If you use the Pepesto API, our API Terms apply in addition to these Terms. They cover what you may do with the data — commercial use, caching, storage, redistribution — and which use cases need a Partner agreement.

Intellectual Property

All content, designs, graphics, and other materials related to our application are owned by Pepesto Solutions GmbH and protected by copyright, trademark, and other intellectual property laws.

Product Information, Allergens and Dietary Data

Product information shown through Pepesto — including names, descriptions, images, prices, availability, ingredients, nutritional values, and allergen data — is compiled from publicly accessible sources and our own research. We refresh it regularly and put real effort into keeping it accurate.

Even so, no product dataset is ever perfectly current. Manufacturers change recipes, packaging, and pack sizes, and supermarkets change prices and ranges — often faster than any dataset can follow. We therefore cannot guarantee that the information is complete, up to date, or free of errors.

Prices and availability change frequently. The price and availability confirmed by the supermarket at the point of checkout are the ones that apply to your order.

Dietary preferences, restrictions, and allergen filtering in Pepesto are a convenience feature, not a safety guarantee. For the reasons above, allergen and ingredient data can be incomplete or out of date. Always read the actual product packaging before consuming any item. If you or anyone in your household has a severe allergy, an intolerance, or a medical dietary requirement, do not rely on Pepesto alone to identify safe products.

Pepesto does not provide medical, nutritional, or dietary advice. Nothing in the Service is a substitute for advice from a qualified healthcare professional.

Limitation of Liability

Pepesto Solutions GmbH shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our application.

Termination

We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

Updates to These Terms

We may periodically update these Terms. We’ll notify you about significant changes by sending a notice to the primary email address registered with your account, or by prominently showing the updated Terms upon opening the mobile application.

Governing Law

These Terms shall be governed by and construed according to EU laws, without respect to its conflict of law principles.

Non-Cancellation and Non-Refund of Completed Grocery Orders

Once a grocery order has been confirmed and completed through Pepesto, cancellations, refunds, or returns are not automatically granted. Given the nature of the products we deal with, primarily food items, there are significant food safety considerations that influence our decision-making regarding returns, cancellations, or refunds. While cancellations and refunds are not guaranteed for completed orders, Pepesto Solutions GmbH reserves the right to evaluate each case individually and make determinations at our sole discretion. By using our service, you acknowledge and agree to this policy.
